Telangana High Court (HC) has ordered Kaloji Narayana Rao University of Health and Science (KNRUHS), to provide admission to the NRI student in MBBS courses offered at the University.
KNRUHS had earlier denied admission in MBBS program to the NRI candidate, stating the student was unable to produce enough evidence of studying Biological Sciences in the qualifying exams.
A bench of justices M.S. Ramachandra Rao and T. Amarnath Goud announced that the KNRUHS should provide admission to the NRI student P. Srikerti Reddy in MBBS course without further insisting her to provide proof of studying Biological Science in the qualifying examination.
The judgement also stated the action of KNRUHS against the NRI student and treating her to be ineligible for admission is arbitrary and illegal.
The NRI student’s father is of Indian origin and she has completed her Class 12 at Conrad High School under West Hartford Board Education, Connecticut in the United States.
P. Srikerti Reddy has also appeared for the National Eligibility cum Entrance Examination (NEET) 2020 undergraduate exam in the foreign national category. She also secured All India Rank 4,82,207.

KNRUHS has denied admission in MBBS course stating that she has no proof of studying Biological science in her qualifying examination on December 12, 2020. Reddy challenged the decision of the university and moved the HC.
School Counsellor of Conard High School issued a certificate to the petitioner on December 11, 2020, stating that she had completed the Advanced Placement Biology Course in which subjects of Biochemistry, Cellular Biology, Organism Biology, Population Biology, Evolution, Genetics and Ecology were covered in deep.
The petitioner’s counsel presented the certificate issued by the School Counsellor to the Court. She also presented the certificate issued by Consulate General of India, New York stating that her 12-year high school diploma certificate in the US is recognized as equivalent to a two-year Intermediate program course in India.
Another certificate was also presented by the petitioner which was issued by Telangana State Board of Intermediate Education confirming the 12th class examination of West Hartford Board of Education is equivalent to Intermediate course.

According to the notification issued by KNRUHS for admission, the petitioner has uploaded the equivalent certificate issued by Intermediate Board.
Additional advocate general J Ramachandra Rao stated that Biological Sciences, Physics and Chemistry were not studied by the students in Class 11 and 12. The student had studied them only in Class 10.
J Ramachandra Rao also argued that the certificate issued by the Intermediate Board did not specifically mention that the student had studied those subjects in Class 11 and 12.
The Bench noted that KNRUHS did not mention this as a reason for making her ineligible for admission in the MBBS course offered at the university. It only mentioned that “no proof of study of biological sciences subject in qualifying examinations.”
KNRUHS also did not mention the validity of the certificate issued by the Intermediate Board. Hence the University cannot make the petitioner ineligible for admission in MBBS course, the Bench concluded.
